In December this year, Antonin Cohen and his collaborators Sébastien Béguerie and Valentin Squirelo plan to launch the first CBD e-cigarette in France, Kanavape – and it will be completely legal because it will not play with THC. I went to his laboratory in the 18th arrondissement of Paris to talk to Antonin. Although per capita alcohol consumption in France has declined since the 1970s, it remains among the highest in the world. In 1991, France introduced some of the world`s most restrictive laws on alcohol advertising, banning it entirely on television and severely limiting what companies can say about their product in other media. Some radio ads are allowed, but only late at night. These laws were intended to reduce underage drinking and binge drinking, but failed. The government then raised the purchasing age (to 18) and introduced a law that made it illegal to encourage excessive alcohol consumption. The France complies with the EU Tobacco Products Directive (TPD) (2014). E-cigarettes can be marketed either as medicines or as consumer products. So far, no product has been approved as a drug. As consumer goods, electronic cigarettes are regulated by the Ordinance of 19 May 2016 on vaping products containing nicotine. The French interpretation of TPD is that the limitation on tank size only applies to preloaded tanks such as pods and tanks. As consumer goods, e-cigarettes cannot be sold in pharmacies.
The cross-border sale of e-cigarettes is legal. Advertising is not allowed, not even on billboards, television, radio or storefronts: it is only allowed in stores. Since 2017, vaping has been banned in educational institutions, public transportation and open-plan offices, although vaping is legal in bars and restaurants. Heated tobacco products are legal and can be marketed, but the situation is a little more complicated for snus. Although it is illegal to import snus for trade or to buy the product online, it is possible to import it for personal use. The Kanavape therefore works with a vaporizer that helps filter CBD.
Is it a kind of e-cigarette? We started with the assessment that people exhibited risky behaviour after using cannabis mixed with tobacco and via conventional combustion.
