We received another report from a neuropsychologist who concluded that the client was in fact unable to plead because of his intellectual disability. When I was a junior lawyer, I represented a young man who was about 19 years old and had an intellectual disability. He was charged with a number of offences, including joint assault, custody of a knife and certain fire-related offences. When I first met him, he seemed quite disheveled and showed up much younger than he was due to his mental disability. He also had behavioral problems and was pretty much asleep. When I took up the case, it was in the local court, and a section 32 request to redirect the case under the Mental Health Act 2007 (NSW) had already been made and dismissed. The prosecution objected to the request, but the judge ultimately concluded that the client was unable to plead and therefore stayed the proceedings.
